COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

TO ALL INTERESTED AGENCIES GROUPS AND PERSONS: The purpose of this notice is to satisfy two (2) separate but related procedural notification requirements for activities to be undertaken by the City of Jeannette PA.
REQUEST FOR RELEASE OF FUNDS On or about October 10 2017 the City of Jeannette will submit a request to the Pennsylvania Department of Community and Economic Development (PA-DCED) for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974 as amended (P.L. 93-383) to undertake a project funded by the FY 2016 CDBG Program for the purpose of downtown street improvements in the City of Jeannette PA.
ASSESSED PROJECT • Downtown Improvements - Street Improvements - Clay Avenue: Funds will be used for a multi-year activity that consists of improvements in the Downtown Business District for Clay Avenue including sidewalks curbs walls and handicapped access ramps on both sides of the street as well as a utility strip for the installation of underground utility lines along with street lights. Year II the work will begin from South Third Street to South Fourth Street. The activity will consist of engineering design and inspection as well as construction work. The estimated CDBG project cost for FY 2016 is $223,826. The above project activity may extend beyond one fiscal year and may require funding from future program years.
FINDING OF NO SIGNIFICANT IMPACT (FONSI) The City of Jeannette has determined that the above-identified project will have no significant impact on the human environment. Therefore an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Jeannette Municipal Building 110 South Second Street Jeannette PA 15644 and is available for public examination and copying upon request during normal business hours Monday through Friday 8:00 AM to 4:00 PM. The activity listed immediately above is assessed under PA-DCED regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. Additional project information is contained in the respective project ERR on file and which is available for review or copying at the same location and time specified in the preceding FONSI statement.
PUBLIC COMMENTS ON FINDING Any individual group or agency may submit written comments on the ERR to the City of Jeannette Municipal Building 110 South Second Street Jeannette PA 15644. All comments received by October 9 2017 will be considered by the City of Jeannette prior to authorizing submission of a request for release of funds. Comments should specify which part of this Notice they are addressing.
ENVIRONMENTAL CERTIFICATION The City of Jeannette certifies to PA-DCED that the Hon. Richard R. Jacobelli in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. PA-DCEDs approval of the Certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Jeannette to use CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS PA-DCED will accept objections to its release of funds and the City of Jeannette's certification received by October 30 2017 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Jeannette; (b) the City of Jeannette has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the City of Jeannette or other participants in the development process have committed funds incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by PA-DCED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the projects are unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58 Section 58.76) and shall be addressed to PA-DCED Office of Community Development Center for Community Building 400 North Street 4th Floor Commonwealth Keystone Building Harrisburg PA 17120-0225. Potential objectors should contact PA-DCED to verify the actual last day of the objection period.
